Notice to Applicants and Prospective Employees

American Utility & Tower Services, LLC (“the Company”) is committed to maintaining a safe, productive, and drug-free work environment for our employees, our clients, and the public. As part of our hiring process, all offers of employment are contingent upon the successful completion of a comprehensive pre-employment background check and screening process.

Scope of Screening

All prospective employees will be subject to the following:

  • Criminal Background Check: Investigation into past criminal history.

  • Motor Vehicle Report (MVR): Investigation into driving records for any position involving the operation of any motor vehicle on behalf of company-related business.

  • Drug Screening: A urinalysis or other approved testing method to detect the presence of illegal drugs or controlled substances.

Disqualification Criteria

An applicant will be disqualified from employment if any of the following occur:

  1. Criminal History: Any felony conviction or any misdemeanor conviction involving fraud, theft, or violence.

  2. Drug Screening: A positive test result for any controlled substance.

    Note on Marijuana: As a safety-sensitive employer, the Company maintains a Drug-Free Workplace. This includes a zero-tolerance policy for marijuana, regardless of whether it is used for medical or recreational purposes, subject to applicable state law.

  3. Driving Record: An MVR that results in the applicant being ineligible for coverage under the Company’s commercial auto insurance policy, or that would result in an increase in the Company’s insurance premiums.

In accordance with the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.), American Utility & Tower Services hereby notifies you that a consumer report and/or an investigative consumer report may be obtained for employment purposes. State-Specific Notices

Florida

In accordance with the Florida Drug-Free Workplace Act (Fla. Stat. § 440.102), the Company operates a drug-free workplace. Applicants have the right to confidentially report the use of prescription or non-prescription medications to the testing laboratory before and after the test.

Indiana

The Company complies with Indiana Code § 22-5-1.7, requiring the use of E-Verify to confirm the work eligibility of all new hires. Criminal history checks are conducted in compliance with Indiana’s “Ban the Box” limitations regarding restricted or expunged records.

Montana

Pursuant to the Montana Workforce Drug and Alcohol Testing Act (MCA 39-2-205), drug testing is required for all positions involving safety-sensitive functions. Applicants will be provided with a copy of the Company’s written testing policy upon request and have the right to explain a positive test result or request a retest at their own expense.

Texas

In accordance with Texas Labor Code § 411.091, the Company maintains a policy to eliminate drug abuse and its effects in the workplace. Applicants are notified that the Company may obtain criminal history record information maintained by the Department of Public Safety.

Wyoming

The Company maintains a drug-free workplace in alignment with the Wyoming Drug-Free Workplace Act. Under Wyo. Stat. Ann. § 27-14-102, an employee’s injury may not be compensable if it is caused by the use of alcohol or controlled substances.
